Terms and Conditions of the Electric Car Salary Sacrifice Scheme

This document constitutes the Terms and Conditions of the GoFor Electric Car Salary Sacrifice Scheme (“the Scheme”).

Salary sacrifice

In return for the provision of the fully managed, maintained and insured company car, as described in your application, leased by your employer, your employer will reduce your total gross pay to enable the Gross Salary Sacrifice to be applied with effect from the Salary Sacrifice Start Date, which will be in the month following the delivery of the car to you. You will still be liable for income tax and National Insurance Contributions (“NIC”) on your contractually reduced total gross pay, (your "Revised Salary") and you must also pay company car tax on your company car. The net salary sacrifice may vary subject to changes in taxation and your employer may, from time to time, vary the Gross Salary Sacrifice to take account of changes in taxation or if the insurance premium changes. Before signing the Salary Sacrifice Agreement, you should read the FAQs, and consider the long term financial commitment you will be undertaking and whether it could create any undue financial hardship now or in the future.

Salary-based benefits

Any occupational pay and benefits related to your salary, such as overtime, bonus, commission, and pension contributions, will not be affected by your participation in the Scheme and all employer provided benefits will continue to be based upon your pre-sacrifice salary that your employer will establish as your “Reference Salary”. Other external arrangements, for example your eligibility for and entitlement to statutory benefits, such as Statutory Sick Pay, Maternity, Paternity , Adoption and Shared Parental Pay, or your entitlement to Universal Credit may be affected, as may any deductions made from your earnings in relation to child maintenance and student loan repayments and your entitlement to child benefit via the calculation of the High-Income Child Benefit Charge. Although further guidance is available via the Scheme FAQs, it is ultimately your responsibility to determine and understand the effect that participation in the Scheme might have on your pay and benefits, state benefits, credits, and charges.

Car

The car will be made available to you as a company car for the term and annual Contract Mileage specified in your application unless your participation in the Scheme is terminated in accordance with these Terms and Conditions.

Lender

The lender will be the owner and registered keeper of the car for the duration of this agreement, and you will not own the car and will have no rights of ownership.

Safe keeping

You are solely responsible for ensuring the safe keeping of the car until it is returned to the lender, except where the car is being serviced, maintained, repaired or tested. 

Road fund licence

Where road tax is payable the cost is included within the Gross Salary Sacrifice for the Contract Term.

Maintenance

The cost of servicing and maintenance required throughout the duration of the Contract Term, including MoTs, repairs, tyres, brakes, exhausts, wipers, and batteries subject to BVRLA Fair Wear & Tear Guidance, are included within your Gross Salary Sacrifice, but it is your responsibility to ensure the car is maintained to manufacturer standards per its specific servicing schedule. You are responsible for taking the car to a garage approved by the lender for regular servicing in line with the manufacturer's service intervals, and where appropriate for arranging an MoT inspection. Maintenance also includes breakdown cover, roadside assistance, and roadside repairs, but does not cover insured incidents such as accidental damage to the vehicle, vandalism, windscreen breakages or other costs such as driver abuse or neglect, including vehicle damage resulting from the vehicle not being serviced according to manufacturer’s specifications.

Checking your eligibility to drive

You are required to complete a DVLA mandate to facilitate the verification of your entitlement to drive and your driving licence details. Details will be verified with the DVLA as and when required. You must notify your employer and the Scheme insurer immediately of any changes to your eligibility to drive.

Terms of use

You agree to adhere to any policies your employer may have in relation to salary sacrifice cars and/or company cars.

Personal use

The car may be driven for personal use by you, and up to two other named drivers, but cannot be used for the purpose of hire and reward, such as taxi or chauffeur services. Your named drivers must meet your employer's minimum driver standards and meet the eligibility requirements of the Scheme insurance provider. Named drivers must also complete a DVLA mandate to facilitate the verification of their entitlement to drive and driving licence details. Details will be verified with the DVLA as and when required. You must notify your employer and the Scheme insurer immediately of any changes to any named driver’s eligibility to drive.

Business use

If you are required to use the car on business, you are bound by your employer’s policies regarding business travel. You will be entitled to reclaim the cost of business mileage at the HMRC Advisory Electricity Rate per mile.

Insurance

Your employer will arrange fully comprehensive motor insurance, and you hereby authorise your employer to deduct the cost of motor insurance as part of the Gross Salary Sacrifice. The insurance premium included within your Gross Salary Sacrifice was calculated according to the Contract Term, as well as the postcode and the age of the youngest driver you selected when you requested your indicative salary sacrifice quotation. You, and all named drivers, will be bound by the terms and conditions and eligibility criteria of the insurance you accepted when requesting your initial salary sacrifice quotation. If you, or any named driver, breach those terms and conditions, you will be liable for any costs associated with the reinstatement or loss of the vehicle, under all circumstances. If the car is involved in an incident that results in it being declared a total loss, the Gross Salary Sacrifice will continue until such time as the insurance claim has been settled at which point it will be terminated. If the car is damaged but not written off the Gross Salary Sacrifice will continue during the period of repair. If you no longer meet the insurance eligibility criteria, for instance you are disqualified from driving, you must declare this immediately to your employer and the Scheme insurance provider. Your insurance may be cancelled and this Agreement terminated unless the insurer accepts a named driver as the replacement main driver.

Deductions from net pay

You authorise your employer to deduct from your net pay any charges, fees, fines, costs and/or other disbursements, including but not limited to those set out below, (together referred to as "Deductions"), incurred by your employer on your behalf in relation to your car, including any administration fees, generally up to £25 (plus VAT), where applicable. Deductions may be spread over more than one payday where appropriate. Where your employer decides it is not appropriate, or practical, for Deductions to be taken from your net pay your employer will send you an invoice, which you must pay within the timeframe specified by your employer, which shall not be less than one calendar month.

Cancellation charges

If you cancel the order before delivery a cancellation fee may be charged by the lender, for which you will be liable. Cancellation fees are generally an amount equal to 3 monthly finance rentals, to cover any costs incurred up to the point of cancellation, which may include:

• cancellation charges applied by the dealer;

• status of the vehicle, for example:

  o is it in stock; or

  o has it been built yet?

• vehicle extras

   o have extras been added at your request; and if so

   o will they impact the ability to resell the vehicle? 

Motoring charges, fines and fees

You are liable for any charges, fines and/or disbursements incurred in relation to your car, including but not limited to parking charges, fines, tolls and congestion charges. It is your responsibility to notify your employer and the Scheme insurance provider of any convictions or endorsements you or any named driver receive.

Insurance costs

You are liable for any cost arising as a result of your breach of the insurance terms and conditions and for any insurance excess, uninsured loss reclaim, or settlement shortfall arising in the event of a total loss determined to be your fault, and any administration fee charged if such costs are not settled within 30 days of invoice.

Early termination charges

Where the lease is terminated before the expiry of the agreed Contract Term, an early termination charge may be applied by the lender. Please refer to the FAQs to determine whether you are covered by the early termination insurance policy. If you are not covered you may be liable to pay the early termination charge unless your employer exercises its discretion not to pass the charge on to you.

Excess mileage charges

Your Contract Mileage is set out on your application to join the Scheme. When the car is delivered to you, and in due course returned by you, its mileage will be logged and you will be liable for any excess mileage charge due, at the rate stated on your application, where the actual mileage exceeds the total Contract Mileage for the Contract Term. It is therefore important that you select an appropriate Contract Mileage for your circumstances and confirm that the Contract Mileage is correct before You sign this Agreement.

Reinstatement costs

When the car is delivered to you, and in due course returned by you, it will be inspected for wear and tear. You are liable for any reinstatement costs levied by the lender in accordance with the BVRLA’s Fair Wear and Tear Guide, which can be found on the BVRLA website. Major dents, scratches and kerbed wheels, for example, are outside these guidelines.

Absence from work other than during parental leave

In the event that you take a prolonged period of paid leave, including sick leave when occupational sick pay is payable, your Gross Salary Sacrifice will continue, and you may retain the car for as long as your total pay is sufficient to meet the full Gross Salary Sacrifice or until the end of the Contract Term if earlier. You will remain liable for any company car tax during any such period. If your total pay becomes insufficient to meet the full Gross Salary Sacrifice, your participation in the Scheme will cease with immediate effect and your Salary Sacrifice Agreement will be terminated. This may result in an early termination charge.

Absence from work during parental leave

You will be entitled to retain your company car for up to 1 year from the start of your Statutory Maternity, Paternity, Adoption or Shared Parental Leave (“parental leave”), or until the end of the Contract Term if earlier. Your Gross Salary Sacrifice will continue to be made if it is sufficient to meet the full Gross Salary Sacrifice, for instance during any period in which you are entitled to be paid occupational parental pay.

If your total pay is not sufficient to meet the full amount of the Gross Salary Sacrifice your Gross Salary Sacrifice will be suspended until the anniversary of the start of your parental leave or your return to work, if earlier. You will remain liable for any company car tax during any such period. On your return to work if your pay is reduced, for example because you return on a part-time basis, and your pay is not sufficient to meet the full Gross Salary Sacrifice, or you do not return to work, your participation in the Scheme will cease with immediate effect and your Salary Sacrifice Agreement will be terminated. This may result in an early termination charge.

Leaving employment

Your participation in the Scheme is for a fixed term, as specified on your application to join the Scheme. In the event that your employment with your employer ceases during the Contract Term, your participation in the Scheme will cease with immediate effect which may result in an early termination charge.

Early termination

Where this Agreement is terminated before the end of the Contract Term you must return the car to the lender in accordance with the lender's instructions unless your employer, at its discretion:

• informs you that it will be reallocating the car to another employee or will be retaining it as a pool car, in which case you must return the car to your employer per its written instructions; or

• allow you, if you so desire and at the discretion of the lender, to reach an agreement with the lender directly to retain the car. You will still be liable for any early termination charge, reinstatement costs and pro rata excess mileage charges which may be applicable.

End of contract

At the end of the Contract Term, unless you, at the discretion of the lender, retain the car by reaching an agreement with the lender directly, you must return the car to the lender in accordance with the lender's instructions.

Data protection

You understand, and will inform any named drivers, that by participating in the Scheme Personal Data provided by you regarding yourself and any named drivers will only be used to implement this agreement and to operate the Scheme. To be able to implement this agreement and operate the Scheme your Personal Data and the Personal Data of any named drivers will be shared with the following Data Processors:

• GoFor Ltd (the Scheme Operator);

• BCF Wessex Limited (the salary sacrifice calculation system provider);

• Lloyd Latchford Group Limited (the motor insurance provider);

• Virtual Insurance Products Limited (the early termination insurance provider); and

• Other third parties as set out in the above Data Processors’ Privacy Policies.

The Personal Data will be processed in accordance with the Data Protection Act 2018, the UK General Data Protection Regulation, the Privacy and Electronic Communications (EC Directive) Regulations 2003 and any other applicable national laws, regulations and secondary legislation in the UK relating to the processing of personal data and the privacy of electronic communications, as amended, replaced or updated from time to time.
